Terms of Service
Last updated October 17, 2026
These are the terms for using TorQ, including the free beta, your price to stay and our money-back guarantee. Questions go to team@gettorqapp.com.
Who These Terms Are With
These terms are an agreement between you and TorQ App LLC, a Delaware limited liability company (“TorQ,” “we,” “us”). They apply however you use TorQ: on gettorqapp.com, in the web app, or in an app on your phone. By using TorQ, you agree to them. If you don't agree, please don't use TorQ.
Our technology provider builds and runs the TorQ app and its servers for us. During the beta you use the TorQ app through TestFlight, Apple's app for beta testing.
Web payments are processed by Stripe. A payment partner may collect a web payment on TorQ App LLC's behalf; your receipt names the company that collected it.
Our Privacy Policy explains how we handle your data.
The Beta
The whole beta is free, before TorQ is in the App Store. In return, we ask for your honest feedback.
It is a beta: some things will be unfinished or broken, and we change the app often. We may add, change or remove features, change how the beta works, or end it.
Before the beta ends, we send you your price to keep TorQ. You see your price before you decide, and it stays open for 14 days.
- If you say yes before TorQ is in the App Store, you enter your card then, you keep access until launch, and you are first charged on launch day.
- If you say yes after launch, you are charged when you say yes.
- If you don't say yes, your free access lasts until launch day. If your price arrives after launch, it lasts 3 days after we send it. Nothing is charged, and there is nothing to cancel.
Paying for TorQ
Before you pay, you see your price and whether it renews each month or each year. Your plan renews automatically at the end of each period until you cancel. If your renewal price changes, we tell you in advance, and you can cancel before the new price applies.
You can cancel online at any time: in the app, open More, tap your name to open Settings, tap Subscription, then Cancel Subscription. Cancelling stops the next renewal, and you keep access through the period you have paid for. If you said yes before launch and cancel before launch day, you are not charged. If you can't cancel in the app, email team@gettorqapp.com and we will do it for you.
If TorQ is sold through the App Store, those purchases are billed by Apple to your Apple account and are managed and cancelled in your Apple account settings.
TorQ Money-Back Guarantee
If you bought TorQ on the web, you can get a full refund within 30 days of your first TorQ charge, as long as you have completed at least 3 workouts in the TorQ app in those 30 days. To check your progress toward the 3 workouts, email team@gettorqapp.com. If you committed before launch, your first charge is on launch day and the 30 days start then. Request the refund from your account settings or by contacting support. TorQ bought through the App Store is refunded by Apple under Apple's rules.
Outside the guarantee you can cancel at any time and keep access through the period you have paid for; partial-period refunds are not provided unless required by law. The guarantee applies once per account.
Your Account
You must be at least 13 years old (16 in the European Economic Area and the United Kingdom, or the minimum age of digital consent where you live) to use TorQ.
Give us accurate information, keep your sign-in to yourself, and tell us at team@gettorqapp.com if you think someone else has used your account. An account is for one person. You are responsible for what happens in your account.
Acceptable Use
When you use TorQ, you agree not to:
- Share your account, or sell or give away access to TorQ.
- Copy, scrape, resell or reverse engineer the app, its programs, its meal plans or the coach, except where the law allows it.
- Use bots, scripts or other automated tools to use or collect data from TorQ.
- Try to get around our security, reach other members' data, or overload our systems.
- Post or send anything unlawful, harmful, hateful or that infringes someone else's rights, or harass anyone, including our team.
- Pretend to be someone else, or give false information to get beta access or a refund.
If you break these rules, we may limit, suspend or close your account.
Not Medical Advice
TorQ's programs, meal plans and the coach's answers are for general fitness and education. They are not medical advice, diagnosis or treatment, and they do not replace a doctor, dietitian or other qualified professional.
Talk to your doctor before you start a new training or nutrition program, especially if you have a health condition or an injury, are pregnant, or take medication. Stop and get medical help if something feels wrong. In an emergency, call your local emergency number.
Exercise carries a risk of injury. By using TorQ, you accept the risks of the exercises and recommendations you choose to follow.
The coach is an AI built on Eric Janicki's program and how he coaches. It is not Eric in person, and like any AI it can be wrong. Use your own judgment, and ask us if something looks off.
Your Content and Our Content
What you put into TorQ, such as your logs, answers and messages, stays yours. You let us use it to run TorQ and coach you, as our Privacy Policy describes.
If you send us feedback or ideas, we may use them to improve TorQ without owing you anything for them.
The TorQ app, its programs, meal plans, coaching content, name and logo belong to TorQ App LLC or to those who license them to us. These terms give you a personal right to use TorQ, not ownership of any of it.
Ending Your Use
You can stop using TorQ at any time, and delete your account in the app or by email, as the Support page explains. We may end your access if you break these terms, or when the beta ends for members who did not keep TorQ.
Our Limits
We work hard to keep TorQ useful and running, but we provide it as it is, especially during the beta. We can't promise it will always be available, free of errors, or that you will reach a particular result.
Except where the law does not allow it, TorQ App LLC, its owners and its service providers are not liable to you for indirect, consequential, exemplary, incidental or punitive damages, including lost profits or physical injury, even if told they might happen.
Nothing in these terms takes away rights you have under consumer protection laws that cannot be waived.
If You Use TorQ Through Apple
These points apply when you get a TorQ app through Apple's App Store or TestFlight:
- These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content, its support and maintenance, and any claims about it, including product liability, legal compliance, consumer protection and privacy claims, and claims that it infringes someone's intellectual property.
- You may use the app on Apple devices you own or control, as Apple's Usage Rules allow. If the app fails a warranty that applies, you may tell Apple, and Apple will refund what you paid for the app; Apple has no other warranty duty.
- You confirm you are not in a country under a US government embargo or named as supporting terrorism, and not on a US government list of prohibited or restricted parties.
- You must also follow the terms of other services you use with the app, such as your mobile data plan.
- Apple and its subsidiaries may enforce these terms against you as third-party beneficiaries.
Changes to These Terms
We may update these terms. When we do, we change the date at the top, and for a material change we tell you by email or in the app before it takes effect. If you keep using TorQ after that, the new terms apply.
Governing Law and Disputes
If something goes wrong, email team@gettorqapp.com first. Most problems can be sorted out quickly that way.
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules, except that the Federal Arbitration Act governs the agreement to arbitrate below.
If we cannot resolve a dispute informally within 30 days, you and TorQ App LLC agree to resolve it by binding arbitration on an individual basis instead of in court. Either of us may instead bring an individual claim in small claims court if it qualifies. You and TorQ App LLC each give up the right to a jury trial and to take part in a class or representative action. You can opt out of arbitration by emailing team@gettorqapp.com with the subject “Arbitration Opt-Out” within 30 days of first accepting these terms. Any dispute not subject to arbitration is heard in the state or federal courts located in Delaware.
